Planetvita names, logos, product names, designs, and slogans may constitute trademarks or other protected intellectual property.

Shopify's names, logos, product names, and related intellectual property belong to Shopify or its licensors.

All other third-party trademarks belong to their respective owners.

Planetvita is powered by Shopify, which enables us to provide the Services.

However, purchases made through the Planetvita store are transactions directly between you and Planetvita.

Shopify is not the seller of Planetvita products.

To the extent permitted by applicable law, Shopify is not responsible for the fulfillment, quality, safety, or performance of Planetvita products or for disputes arising directly between you and Planetvita concerning those products.

Nothing in these Terms affects rights or liabilities that cannot lawfully be excluded.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Certain personal information may also be processed by Shopify in accordance with Shopify's applicable privacy policies.

Where technically applicable, Agents should accurately identify themselves and must not conceal the automated nature of their activity.

Termination does not affect payment obligations or rights and liabilities that accrued before termination.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

In particular, nothing in these Terms is intended to exclude or restrict liability for death or personal injury where such liability cannot lawfully be excluded, or any other liability that applicable law prohibits us from excluding or limiting.

Where liability may lawfully be limited, it will be limited only to the fullest extent permitted by applicable law.

Nothing in this section affects any mandatory consumer rights or remedies available to you.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Planetvita, the Company, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from reasonable third-party claims, losses, damages, liabilities, and expenses arising directly from:

  1. your material breach of these Terms;

  2. your unlawful use of the Services;

  3. your violation of another person's legal rights; or

  4. content or Feedback you submit where such content violates applicable law or third-party rights.

This indemnity does not apply to the extent a claim results from the negligence, wrongful conduct, or breach of obligation of Planetvita or another indemnified party.

Nothing in this section imposes an obligation that cannot lawfully be imposed under applicable law.

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.

The remaining provisions will continue in full force and effect.

You may not assign or transfer your material rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may assign or transfer our rights and obligations under these Terms in connection with:

  • Corporate restructuring

  • Sale of business or assets

  • Transfer to an affiliate

  • Other legitimate business reorganization

provided that such transfer does not unlawfully reduce your rights.

Nothing in this section is intended to deprive a consumer of any mandatory rights or protections that cannot lawfully be waived or excluded under laws applicable to that consumer.
